CORAM : HON'BLE MR. JUSTICE H.S.GREWAL Present:- Mr. Shivam Chaudhary, Advocate for the petitioner. Mr. Sanyam Khetarpal, Advocate for the complainant. Mr. Neeraj Sheoran, Sr. DAG,Haryana.
*** H.S. Grewal, J.(Oral) CRM-35611-2026 This application has been filed under Section 528 BNSS (formerly Section 482 Cr.P.C) for placing on record the original full and final compromise dated 22.06.206 between the parties. For the reasons stated in the application, the same is allowed and original full and final compromise dated 22.06.206 between the parties is ordered to be taken on record. Main case
1.
The present has been filed under Section 483 BNSS (Section 439 Cr.P.C.) seeking regular bail in FIR No. 110 dated 20.04.2026 under Sections 109(1), 115, 118(1), 191 (3), 324(4), 351(3), 190 of BNS (earlier Sections RENU RAWAT 2026.08.27 18.57 I attest to the accuracy and integrity of this document Chandigarh
CRM-M-31029-2026(O&M) -2- 307,323,324,148,427,506,149 ) registered at Police Station Bilaspur District Yamuna Nagar.
2. The prosecution case, in brief, is that on 19.04.2026 at about 6:23 p.m., the complainant Randhir received a threatening telephonic call from the son of the petitioner. After reporting the matter to the police, while returning home, the complainant was allegedly intercepted by the petitioner, along with co-accused Deepak and others, who were armed with weapons. The petitioner allegedly hit the complainant's motorcycle from behind, whereafter the accused persons assaulted the complainant, Dharamveer, Yudhbir and Shubham with their respective weapons and also attempted to run their vehicle over the complainant party. On hearing the hue and cry, Seema and Poonam allegedly intervened to rescue the complainant party. During the incident, the petitioner allegedly injured Seema's left-hand finger with an axe, while Shubham sustained an injury on his arm allegedly caused by a sharp-edged weapon.
3.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in a village dispute arising out of the same occurrence, in which cross-FIRs have been registered. The parties have amicably compromised the matter, and the complainant has no objection to grant of regular bail. The injuries attributed to the petitioner are simple in nature, with none declared dangerous to life, and therefore Section 109 BNS is not attracted. No further recovery is pending and custodial interrogation is not required. The petitioner, aged about 20 years, has been in custody since RENU RAWAT 2026.08.27 18.57 I attest to the accuracy and integrity of this document Chandigarh
CRM-M-31029-2026(O&M) -3- 02.05.2026, has clean antecedents, and the trial is yet to commence. His continued incarceration would amount to pre-trial punishment. 4. Learned State counsel, while opposing the bail, submits that the allegations against the petitioner are serious and specific. The petitioner is alleged to have participated in the assault along with other accused persons and to have caused injury to Seema with an axe, while the complainant party was allegedly attacked with weapons. 5. L.d counsel for the complainant submits that matter has been compromised with the parties and he has no objection if the bail is allowed. 6. I have heard the learned counsel for the parties and perused the record. 7. Keeping in view the facts and circumstances of the case and the fact that petitioner has been in custody since 02.05.2026 and the matter has been compromised with the parties, therefore, this Court deems it appropriate to grant the concession of regular bail to the petitioner during the pendency of the trial as the continuous detention of the petitioner would not serve the ends of justice. 8. Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bail bonds, surety bonds to the satisfaction of the learned trial Court/Duty Magistrate/Chief Judicial Magistrate concerned. 9. However, it is made clear that in case the petitioner misuses the concession of bail, the State/complainant would be at liberty to seek cancellation of his bail.
