JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before this Court calling in question the proceedings in S.C.No.15/2022 registered for offences punishable under Sections 323, 324, 504, 506, 354(A), 307, 326 r/w 34 of IPC. 2. Heard Sri. Nikhil Sai, learned counsel appearing for the petitioners, Smt. Deepthi Alva, learned HCGP appearing for - 4 - HC-KAR CNR: KAHC010540302026 NC: 2026:KHC:45697 CRL.P No. 11882 of 2026 respondent No.1, Smt. Yuktha N., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have placed on record the compromise petition. Terms of settlement reads as follows: "MEMORANDUM OF COMPROMISE PETITION UNDER SECTION 528 OF THE BHARATIYA NAGARIK SURAKSHA SANHITA, 2023 The Petitioners and the Respondent No.2 submit as follows: 1. It is submitted that the present petition is filed by the Petitioners seeking quashing of the entire proceedings in S.C. No. 15/2022 pending before the Learned LXXI Addl. City Civil & Sessions Judge, Bengaluru for the offences u/s. 323, 324, 504, 506, 354(A), 307, 326 r/w. 34 of the IPC arising out of FIR bearing Crime No. 171/2020 registered before the Respondent No.1 police Petitioners herein. 2. The Petitioners and Respondent No.2, being relatives, had certain misunderstandings which led to - 5 - HC-KAR CNR: KAHC010540302026 NC: 2026:KHC:45697 CRL.P No. 11882 of 2026 the lodging of the Complaint and the subsequent registration of FIR in Crime No. 171/2020 by the Respondent No.1 Police Station. Thereafter, with the intervention and considered advice of elders and well-wishers of both families, the parties have amicably resolved all their differences and have mutually agreed to settle the matter in its entirety. 3. Accordingly, the Respondent No.2 submits that she has no objection to the quashing of the entire proceedings in S.C. No. 15/2022 pending before the Learned LXXI Addl. City Civil & Sessions Judge, Bengaluru for the offences u/s. 323, 324, 504, 506, 354(A),307, 326 r/w. 34 of the IPC arising out of FIR bearing Crime No. 171/2020 registered before the Respondent No.1 police as against the Petitioners herein. 4. It is submitted that in terms of the settlement arrived between the parties, the Respondent No.2 has no objection to allow the present petition and quash the entire proceedings in S.C. No. 15/2022 pending before the Learned LXXI Addl. City Civil & Sessions Judge, Bengaluru for the offences u/s. 323, 324, 504, 506, 354(A), 307, 326 r/w. 34 of the IPC arising out of FIR bearing Crime No. 171/2020 - 6 - HC-KAR CNR: KAHC010540302026 NC: 2026:KHC:45697 CRL.P No. 11882 of 2026 registered before the Respondent No.1 police as against the Petitioners herein. 5. It is further submitted that, the Petitioner No.2 herein, has initiated proceedings in S.C. No. 1020/2022 pending before the Learned LXXI Addl. City Civil & Sessions Judge, Bengaluru against the Respondent No. 2 herein and others for the offences u/s. 323, 324, 427, 307. 506, 326 r/w. 149 of IPC arising out of FIR bearing Crime No. 172/2020 registered before the Respondent Subsequently, the Respondent No. 2 herein along with others have filed Crl. P. No. 11843/2026 pending before this Hon'ble Court for quashing of the same. As per the terms of the settlement arrived between the parties, the Petitioner No.2 herein has unequivocally agreed to tender no objection to allow Crl. P. No. 11843/2026 pending before this Hon'ble Court and quash the entire proceedings S.C. No. 1020/2022 pending before the Learned LXXI Addl. City Civil & Sessions Judge, Bengaluru for the offences u/s. 323, 324, 427, 307, 506, 326 r/w. 149 of the IPC arising out of FIR bearing Crime No. 172/2020 registered before the Respondent No. 1 police. 6. The Petitioners and Respondent No. 2 agree not to initiate any further legal proceedings, whether civil or - 7 - HC-KAR CNR: KAHC010540302026 NC: 2026:KHC:45697 CRL.P No. 11882 of 2026 criminal, against each other before any Court or Authority for the same cause of action. 7. Both the Parties herein further state that there has been no collusion or force, fraud or any undue influence in entering into the settlement or agreement in the aforesaid manner. The parties agree that the present compromise petition is a reflection of their understanding and the terms of the same are finalized after due deliberations, amicably and upon mutual consent. Hence, the terms of the present petition are binding on the parties and shall not be challenged by them. Wherefore, it is prayed that, this Hon'ble court may be pleased to allow the present petition as prayed for and quash the entire proceedings in S.C. No. 15/2022 pending before the Learned LXXI AddI. In the light of Compromise Petition being filed and offences not being against the State, I deem it appropriate to accept the Compromise petition and terminate the proceedings against the petitioners in the subject petition. 5. For the aforesaid reasons, the following: ORDER i. Criminal Petition stands disposed. ii. Proceedings pending in S.C.No.15/2022 before the LXXI Addl.
