ORAL ORDER
1. Accused No.2 in Crime No.115/2026 registered by Basaveshwaranagar Police Station, Bengaluru District, for the offences punishable under Sections 109, 115(2), 118(1), 126(2), 351(2), 352 read with 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of the BNSS, 2023, seeking regular bail.
2. Heard the learned counsel for the parties.
3. FIR in Crime No.115/2026 was registered by Basaveshwaranagar Police Station, Bengaluru District, against Usman Pasha and others based on the first information dated 16.03.2026 received from Sayyed Irshad, who is one of the injured victims in the present case. During the course of investigation, the petitioner herein was arrested on 18.03.2026

and was remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.6618/2026 was rejected on 16.07.2026. Therefore, he is before this Court.

A perusal of the material on record would go to show that the allegation of assaulting the injured victim - first informant with the dagger and causing blood oozing injury is found in the first information against accused Nos.1 and 2. The wound certificate of first informant would go to show that he has suffered only one injury, which is stated to be simple in nature. Even the other injured victims in the present case have only suffered simple injuries as a result of assault made by accused persons. Investigation of the case is now completed and charge sheet is filed against 5 persons. It is brought to the notice of this Court that the petitioner is a person with criminal antecedents and as against him there are two other criminal cases registered.
5. Considering the nature of allegations found against the petitioner in the present case and also having regard to the fact that the injured victims have suffered only simple injuries in the

incident in question, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions.
6. Accordingly, the following:
ORDER
The criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No. No.115/2026 registered by Basaveshwaranagar Police Station, Bengaluru District, for the offences punishable under Sections 109, 115(2), 118(1), 126(2), 351(2), 352 read with 3(5) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts their appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;

d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is
disposed of.
