This petition is filed seeking the following reliefs: A. Issue a writ in the nature of certiorari or any other appropriate writ/order/direction, quashing and setting aside the order dated 08.02.2021 vide Annexure-A passed by the Hon'ble Industrial Disputes Tribunal and the consequent order dated:29.11.2022 vide Annexure-B passed by the Hon'ble Industrial Disputes Tribunal in I.D.No.212/2012, titled 'Group 4 Securicor Security Services Workers Union, India v. M/s G4S Secure Services India Pvt. Ltd.' pending adjudication before the Hon'ble Industrial Tribunal. - 3 - HC-KAR CNR: KAHC010233582023 NC: 2026:KHC:47121 WP No. 9921 of 2023 B. Issue a writ in the nature of certiorari or any other appropriate writ/order/direction, quashing and setting aside the warrants / summoning order dated 15.03.2023 vide Annexure-M issued by the Industrial Tribunal in I.D.No.212/2012 titled 'Group 4 Securicor Security Services Workers Union, India v. M/s. G4S Secure Services India Pvt. Ltd. C. Issue such other writ, order or direction as deemed fit in the circumstances of the case, in the interest of justice and equity. 3. Counsel for the respective parties urged several contentions. Heard arguments and perused the papers with utmost care. 4. The issue is limited in scope and pertains to the Tribunal's order on interim applications Nos.4, 5, and 6. 5. Suffice it to note that the Union raised a dispute in I.D.No.212/2012. During the pendency of the dispute, the Union initially filed two applications under Section 11 of the I.D. Act, calling upon the management/second party to produce the documents/contracts entered into between them and the persons /people mentioned in the applications. The applications - 4 - HC-KAR CNR: KAHC010233582023 NC: 2026:KHC:47121 WP No. 9921 of 2023 filed by the Union are furnished along with the writ petition and marked as Annexure-H. A review of the same reveals that the Union aimed to obtain a direction to produce management documents related to 41 persons or companies. The court has examined the application thoroughly. Interestingly, the Union provided two survey numbers (Sl.No.40 and 41), which seems odd since survey numbers should not typically be included when requesting such directions. Moreover, the court unexpectedly approved the application without proper scrutiny. Sri N. Venkate Gowda, the Vice President, submitted an affidavit containing a declaration of fact, but it did not specify the current status of the individuals or companies involved. The Tribunal accepted the applications without due process, approved them, and issued the warrant - a procedure that is legally untenable. Additionally, neither the Union nor the Court can require management to produce documents or summon witnesses, even those with whom management has agreements. The grounds for granting the applications are unsustainable. Therefore, the orders regarding interim - 5 - HC-KAR CNR: KAHC010233582023 NC: 2026:KHC:47121 WP No. 9921 of 2023 applications Nos.4 and 5, along with the later warrant, are liable to be quashed. 6. The writ of certiorari is ordered. The order dated 08.02.2021 passed by the Industrial Tribunal in I.D.No.212/2012 vide Annexure-A; the order dated 29.11.2022 passed by the Industrial Tribunal in I.D.No.212/2012 vide Annexure-B and the warrants / summoning order dated 15.03.2023 issued by the Industrial Tribunal in I.D.No.212/2012 vide Annexure-M are quashed. 7. Resultantly, the writ petition is allowed. On disposal of the Writ Petition, any interim order stands discharged, and pending interlocutory applications, if any, are disposed of.
