Learned advocate appearing for the petitioner submits that petitioner has been implicated on the accusation of possessing of 2.060 Kgs. of Ganja. Petitioner allegedly was intercepted at the Airport and subsequently he was put behind the bars.
Learned advocate for the Air Customs Authorities opposes the prayer for bail.
I have taken into account the fact that complaint has already been submitted before the jurisdictional Court.
Having regard to the quantum of recovery in the present case and relying upon the judgment of Barnali Bag vs. Union of India (Special Leave Petition (Crl.) No. 3641 of 2026 I am
2 of the opinion that the petitioner is entitled to be released on bail.
Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Md. Ashfaque shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, 6th Court, Barasat, North 24 Parganas. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of North 24 Parganas and South 24 Parganas without the prior permission of the learned Special Court.
Additionally, petitioner shall also make himself available before the investigating officer or any officer assigned by the Principal Commissioner Airport, Air Customs Authorities.
With the aforesaid observations CRM (NDPS) 1800 of 2026 is allowed.
All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
3 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
