The petitioners are before this Court calling in question the proceedings arising out of crime in Crime.No.26/2026, registered by the Southeast Women Police Station, Bengaluru City, for offences punishable under Sections 85, 115(2), 351(2), 352, of Bharathiya Nyaya Sanhita 2023, and 3 and 4 of Dowry Prohibition Act, 1961. 2. Heard Sri. Bharath K., learned counsel appearing for the petitioners, Smt. Deepthi Alva, learned HCGP appearing

for respondent No.1, Smt. Yogasree, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of these proceedings, it transpires that the parties to the lis have entered into a settlement and have filed an application under Section 359(6) of BNSS 2023 along with joint affidavit. Terms of settlement reads as follows:
"APPLICATION UNDER SECTION 359 (6) OF BNSS- 2023 R/w SECTION 528 OF BNSS-2023
The Petitioners and Respondent No.2 above named most humbly state as under:
1. The Petitioners have preferred the above Writ Petition challenging the proceedings arising out of the Complaint dated 24.02.2026 and FIR registered in Crime No.0026/2026 on the file of the Southeast Women Police Station, Bengaluru City, for the offences punishable under Sections 85, 115(2), 351(2) and 352 of the Bharatiya Nyaya Sanhita, 2023, read with Sections 3 and 4 of the Dowry Prohibition Act, 1961, insofar as the Petitioners herein are concerned. 2. The Petitioners respectfully state that, due to the intervention of friends, elders, family members and other

well-wishers, the matrimonial disputes between Accused No.1/Sri. Yatheesha B.E. and Respondent No.2 have been amicably settled through mediation in M.C. No.4725/2026 before the Hon'ble Principal Family Court at Bengaluru. Pursuant to the said settlement, Accused No.1/Sri. Sri Yatheesha B. E and Respondent No.2 consented for dissolution of their marriage by mutual consent. In view of the settlement arrived at between the parties, the Hon'ble Principal Family Court at Bengaluru was pleased to dispose of M.C. No.4725/2026 on 10.08.2026. 3. The Petitioners state that, pursuant to the aforesaid settlement. Respondent No.2 has agreed and consented to the closure and quashing of the impugned proceedings arising out of Crime No.0026/2026, registered by the Southeast Women Police Station, Bengaluru City, for the offences punishable under Sections 85.
115(2), 351(2) and 352 of the Bharatiya Nyaya Sanhita. 2023, read with Sections 3 and 4 of the Dowry Prohibition Act, 1961. insofar as the Petitioners herein are concerned. 4. As per the understanding arrived at between the parties, Respondent No.2 has agreed that she would not prosecute the impugned criminal proceedings against the Petitioners herein and has no objection for quashing/closure of the proceedings arising out of Crime No.0026/2026 registered by the Southeast Women Police Station, Bengaluru City, for the offences punishable under Sections 85, 115(2), 351(2) and 352 of the

Bharatiya Nyaya Sanhita, 2023, read with Sections 3 and 4 of the Dowry Prohibition Act, 1961, insofar as the Petitioners herein are concerned. WHEREFORE The Petitioners and Respondent No.2 most humbly pray that this Hon'ble Court may be pleased to quash the proceedings arising out of Crime No.0026/2026 registered by the Southeast Women Police Station, Bengaluru City, for the offences punishable under Sections 85, 115(2), 351(2) and 352 of the Bharatiya Nyaya Sanhita, 2023, read with Sections 3 and 4 of the Dowry Prohibition Act, 1961, insofar as the Petitioners herein are concerned, in the interest of justice and equity". 4. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against the petitioners in the subject petition. 5. For the aforesaid reasons, the following:
ORDER i. Writ Petition stands disposed.
