In Re : Sankar Das and others ... Petitioners.

... For the Petitioners.
Ms. Mayukhi Mitra, Mr. Anirban Kumar Banerjee
... For the State.
Learned advocate appearing for the petitioners submits that petitioner no.1 and petitioner no.3 are brothers-in-law of the deceased and petitioner no.2 and petitioner no.4 are their wives. It has been submitted that the husband was arrested and subsequently released on bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for anticipatory bail and submits that there are complicity of the present petitioners. To that effect, attention of the Court is drawn to the statement of the child. I have taken into account the statement of the child who narrated the incident as an eyewitness. Having considered the same, I am of the opinion that this is not a fit
2 case for granting anticipatory bail to the present petitioners. As such, the prayer for anticipatory bail of the petitioners is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for anticipatory bail, being CRM (A) 2867 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
