ORAL ORDER
The petitioners are before this Court seeking the following prayer:
"WHEREFORE, the Petitioners above-named pray that this Hon'ble Court be pleased to quash the Order of cognizance dated 19.01.2026 passed by the Hon'ble XXIX Additional Chief Judicial Magistrate, Mayo Hall Unit, at Bengaluru in C.C. No. 51763/2026, and the

consequent criminal proceedings, and pass any other
Order(s) as it may deem fit in the facts and circumstances of the case, in the interest of justice."

Heard Sri.Shashank Nagendran, learned counsel appearing for the petitioners, Smt.Deepthi Alva, learned HCGP appearing for respondent No.1, Sri.B.Poorna Chandra, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint affidavit. The joint affidavit reads as follows:
“1. We, Deponent Nos.1 to 3 and 4 are the Petitioners and the Respondent No.2 in the instant Petition, respectively. We are well conversant with the facts and circumstances of the case, and we are competent to Swear to this Affidavit. 2. A case in Crime No.69/2025 came to be registered by the Whitefield Women Police Station, against the Deponent Nos. 1 to 3 herein, for the offences punishable under Sections 85 read with 3(5) of the Bhartiya Nyaya Sanhita, 2023 and Sections 3 and 4 of the Dowry Prohibition Act, 1961, on the basis of the Complaint of the Deponent No.4, the De-facto Complainant/Respondent No.2 dated 19.08.2025. 3. The gist of the Complaint filed by the De-facto Complainant/Respondent No. 2 is as follows:

i. The De-Facto Complainant along with her parents have given 70 grams of gold ornaments which include one gold bracelet, one gold chain and gold rings. It is further alleged that the parents of the De-Facto Complainant have conducted the engagement ceremony which cost up to INR. 3,00,000/- (Indian National Rupees of Three Lakh Only), only on the demand of the Petitioner Nos. 2 and 3. After which, the parents of the De-Facto Complainant have also conducted the marriage between the De-Facto Complainant and the Petitioner No. 1 in Surya Pratap Kalyana Mantapa, Chittoor, Andhra Pradesh and has spent INR. 20,00,000/- (Indian National Rupees of Twenty Lakh Only) for the wedding ceremony. ii. Further alleged that, after the marriage, the Petitioner No. 1 and the De-Facto Complainant have been residing together at CKB Layout, Munnekollal Village, Marathahalli, Bengaluru. iii.
Further, the Petitioner No. 1 has shown explicit videos to the De-Facto Complainant and has demanded to do the same with him, for which the De-Facto Complainant refused and the Petitioner No. 1 accused her of not being a woman and of having all kinds of diseases. Further, there would occur some trivial fights between them and Petitioner No. 1 would hurl abuse against the De-Facto Complainant. iv. Further alleged that, on 26.05.2024, Petitioner No. 1 physically assaulted the De-Facto Complainant. Due to these fights between them, Chargesheet Witness Nos.4 to 8 have tried to reconcile and stall the issues on several occasions. v. Furthermore, when the De-Facto Complainant visited the Petitioner No. 1's native place in Andhra Pradesh, he demanded more dowry. The Petitioner No. 3 would make rules in the kitchen that the De- Facto Complainant should not touch anything else but eat what is made and when the same was questioned by the De-Facto Complainant, Petitioner Nos. 1 to 3 slapped her and have physically and mentally tortured her. Hence, the Complaint. 4. The Parties have mutually agreed to compromise their

disputes amicably and resolve the same with a view to bring closure to the marital dispute between the Petitioner No. 1/Deponent No. 1 and the Respondent No. 2/Deponent No. 4 and enable them to move forward in their separate lives and have agreed to part ways through divorce. 5. Further that Deponent No. 4 has given her no objection/consent of her own free will and that there is no pressure or undue influence being exercised on her by either Deponent Nos. 1 to 3 and/or anybody else. 6. In view of the amicable resolution of disputes between Deponent Nos.
1 to 4, it is humbly stated that this is a fit and proper case for this Hon'ble Court to exercise its inherent power to quash and set aside the Order of cognizance dated 20/01/2026 passed by the Hon'ble XXIX Additional Chief Judicial Magistrate, Mayo Hall Unit, at Bengaluru in C.C. No. 51763/2026. 7. Therefore, the Deponents above named jointly pray that this Hon'ble Court be pleased to consider the Compromise between the Deponents herein and on that basis, quash the Order of cognizance dated 20/01/2026 passed by the Hon'ble XXIX Additional Chief Judicial Magistrate, Mayo Hall Unit, at Bengaluru in C.C. No. 51763/2026, as prayed for in the instant Petition, in the interest of Justice.”
4. The parties to the lis are present before the Court and are identified by their respective counsels. 5. In the light of application for compounding being filed along with the joint affidavit as quoted supra and offences not being against the State, I deem it appropriate to accept the

same and terminate the proceedings against the petitioners in the subject petition. 6. For the aforesaid reasons, the following:
ORDER [I] Criminal Petition is disposed. [II]
Order of cognizance dated 19.01.2026 passed by the XXIX Additional Chief Judicial Magistrate, Mayo Hall Unit, at Bengaluru in C.C.No.51763/2026 and the consequent criminal proceedings, stands quashed qua the petitioners.
