And In Re : Hasina Khatun ... Petitioner. Mr. Kusal Kumar Mukherjee, Mr. Arijit Bose ... For the Petitioner. Mr. Sagar Saha, Ms. Nayana Mukhopadhyay ... For the State. Learned advocate appearing for the petitioner submits that petitioner is pregnant and suffering from complications. As such, petitioner may be released on bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that total recovery in the present case is 5.287 kgs. of Heroin. The prosecution case reflects that petitioner was engaged in packaging with the other accused for supply of Heroin. Having considered the active participation of the present petitioner when she was pregnant, I am of the view that this is not a fit case to release the petitioner on bail on the grounds of pregnancy. As such, the prayer for bail of the petitioner is rejected. However, the learned Special Court is directed to pass necessary directions so that the life of the petitioner during 2 her pregnancy stage including her medical treatments as also the child which may be born be secured by ensuring proper hospital facilities. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1812 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
