The petitioner, in this Writ Petition, has prayed for the following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to direct the respondent no. 4 i.e. Tahsildar, Bodri, District Bilaspur (C.G.) to consider and decide the pending revenue case, for issue of grant- PRIYANKA VERMA Digitally signed by PRIYANKA VERMA Date: 2026.09.26 10:50:39 +0530 2 in aid (Sahayata Rashi) to the petitioner, under proviso of clause of 6(4) of Revenue Book Circular, within stipulated time, in the interest of justice. 10.2 That, this Hon'ble Court may kindly be pleased to direct the respondent no. 4 to decide the application, in the interest of justice. 10.3 That, any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the cost of the petition may be given.” 2. Facts of the case in brief are that the petitioner's husband- Ravishankar Singhraul, while bathing in the Shivnath River near Shivnath River Railway Bridge on 14.10.2024 at about 8:00 p.m., accidentally drowned in deep water and died. Thereafter, the petitioner submitted an application before the concerned Tahsildar seeking grant-in-aid under Clause 6(4) of the Revenue Book Circular, which is still pending consideration. Hence, this petition. 3. Learned counsel for the petitioner submits that the petitioner has filed an application under Clause 6(4) of the Revenue Book Circular before the concerned Tehsildar, Bodri, seeking grant of compensation on account of the death of her husband due to drowning. However, the said application has not been decided by the concerned Tehsildar, Bodri till date, therefore, necessary direction may be issued to the concerned authority. 4. Learned State counsel submits that the relevant documents goes to show that the concerned Tehsildar has to decide the application, as the petitioner has filed the entire documents. 3 5. Heard learned counsel for the parties and perused the material available on record. 6. It is highly surprising that despite receipt of the application dated 21.11.2024, the concerned Tehsildar, Bodri, District Bilaspur, has kept the said application pending for the reasons best known to him and has not decided the same till date, which is highly objectionable. If any application is filed before the concerned authority, the authority is under an obligation to consider and decide the same in accordance with law. The concerned authority cannot keep such an application pending. Accordingly, the concerned Tehsildar, Bodri, is directed to decide the said application after giving due opportunity of hearing to the petitioner within a period of 15 days from the date of receipt of a copy of this order and to communicate the order along with his affidavit before the Registrar (Judicial) forthwith. 7. It is made clear that this Court has not expressed any opinion on the merits of the case. 8. The petitioner is directed to file a copy of this order before the concerned Tehsildar immediately. Learned State counsel is also directed to communicate the passing of this order to the concerned Tehsildar. 9. With the aforesaid observations and directions, the present petition stands disposed of.
