Kausik (Rejected) CRM (NDPS) 1797 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Dalkhola Police Station Case No. 288/2025 dated 20.09.2025 under Sections 21(c)/29 of the NDPS Act. And In the matter of : Md. Basir Alam ……Petitioner. Ms. Minoti Gomes Mr. Kausik Biswas Mr. Debojyoti De ……for the Petitioner. Mr. Debajyoti Deb Ms. Pramita Banerjee ……for the State. Learned advocate appearing for the petitioner submits petitioner is in custody for 11 months. Charge sheet has already been submitted, charges have been framed. However, witness action is yet to commence. There is no possibility of the trial being taken to its logical conclusion. As such, petitioner prays for bail. Learned advocate for the State opposes the prayer for bail as there has been recovery of 815 Gms. of Brown Sugar. Attention of the Court has been drawn to the Chemical Examiner’s Report and it has also been submitted that there was a specific recovery of 305 Gms. from the present petitioner. 2 Additionally, it has been submitted that there are Call Data Records and money trail existing in the present case. Having considered the quantum of recovery in the present case, I am not inclined to release the petitioner on bail at this stage. Petitioner will renew his prayer for bail after the evidence of the seizure list witnesses is over. Accordingly, CRM (NDPS) 1797 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
