Mr. Soumitra Bandyopadhyay Mr. Priyabrata Batabyal ….for the petitioners This application under Article 227 of the Constitution of India is at the instance of the plaintiffs/appellants in Title Appeal No.36 of 2022 praying for a direction upon the learned Additional District Judge at Hooghly to dispose of the title appeal expeditiously. Mr. Bandyopadhyay, learned advocate appearing for the petitioners submits that taking advantage of the pendency of the title appeal the opposite parties herein are creating disturbance in the peaceful possession of the petitioners in the suit property. The opposite parties are cutting valuable trees from the suit property. It will be open to the petitioners to take out an appropriate application before the learned judge of the Appellate Court insofar as the aforesaid grievance of the petitioners is concerned. In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate for the petitioners shall be obliged to forward a copy of this application along with this order upon the opposite parties or the learned advocate representing the opposite parties before the learned trial judge. 2 From the order sheets appended to this application, this Court finds that the regular Presiding Officer is not available and the learned Additional District Judge, 1st Court at Howrah is in-charge of the said Court. After the regular Presiding Officer joins the learned Additional District Judge at Howrah shall make an endeavour to dispose of the Title Appeal No.36 of 2022 as expeditiously as possible but preferably within a period of 6 months from the date when the regular Presiding Officer joins without granting any unnecessary adjournments to either of the parties. With the above observations, CO 2893 of 2026 stands disposed of. There will be no order as to costs. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Hiranmay Bhattacharyya, J.)
