Learned Additional Government Advocate accepts notice for respondent Nos.1 and 2. 2. Petitioner is before the Court seeking for the following reliefs: a. To issue Writ of Mandamus to the respondents directing them to restore the name of petitioner Yes Bank Limited at hypothecation column in Registration Certificate with respect to vehicle - 3 - HC-KAR CNR: KAHC010305492026 NC: 2026:KHC:46125 WP No. 14019 of 2026 HYUNDAI VERNA/CRDI SX1.6 vehicle bearing registration NO.KA03NL3963, Chassis NO.MALC041FLNM315086 and engine No.D4FANM470300 vide Anneuxre-J. b. To pass any such other appropriate relief as this Hon'ble Court deems fit in the circumstances of the case, in the interest of justice and equity. 3. The submission of learned counsel for the petitioner is that the vehicle having been hypothecated to the petitioner, the name of the petitioner is required to be included in the registration certificate. In pursuance of which, the representation having been furnished at Annexure-J has not been considered. 4. Learned Additional Government Advocate submits that the representation cannot be considered in that regard. The necessary application in the applicable format as per the form prescribed would have to be submitted, which has not been so submitted, and as such, the representation could not be considered. His further submission is that such an application has to be jointly made by the person who has availed of the loan as also the banker who has advanced the loan. 5. Be that as it may, when a representation has been submitted by a bank, it was required for the respondents to consider the same and pass necessary orders by giving reasons for either - 4 - HC-KAR CNR: KAHC010305492026 NC: 2026:KHC:46125 WP No. 14019 of 2026 accepting or rejecting the representation. Neither of them having been done, this Court passes following: ORDER i. Writ petition is party allowed. ii. A mandamus is issued, directing the respondents to consider the representation of the petitioner at Annexure-J and pass necessary orders within a period of 30 (thirty) days from the date of receipt of a certified copy of this order. iii. It is made clear that this Court has not expressed any opinion on the entitlement of the petitioner. The same would have been considered by the respondents in accordance with law.
