Mr. Samrat Choudhury, Mr. Sayan Ray, Ms. Arju Sahani …for the petitioner This is an application for expeditious disposal of the discharge application filed by the petitioner in connection with CGR Case No.3813 of 2013 presently pending before learned Judicial Magistrate, 6th Court, Alipore. Being aggrieved by the extreme delay caused in disposal of the application for discharge filed by the instant petitioner, learned Counsel for the petitioner submits that the instant criminal proceeding was initiated in the year 2013 and the charge-sheet was also submitted in the same year. Thereafter, the petitioner preferred a discharge application on 21.09.2024, since then the application is pending for disposal. Therefore, he prayed for necessary direction upon the Court below for expeditious disposal of the said application. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with. 2 Having considered submission made on behalf of the petitioner that the discharge application is pending for about 2 years, I find that the prayer made by the petitioner is justified and is required to be allowed to secure the ends of justice. In view of above, the instant application being CRR 3337 of 2026 is hereby disposed of with a direction upon the Court below to make his every endeavour for expeditious disposal of the said discharge application dated 21.09.2024 within a period of 45 days from the date of communication of this order.
