APP Mr. Amartya Mohan Bhattacharyya … for the State-respondent(s) Mr. Susnigdha Bhattacharya … for the Victim Mr. Mukherjee, learned Senior Advocate, draws the attention of the court to the earlier order dated 16.02.2026 passed in CRM (M) 2624 of 2025. There was a prayer for recall in respect of P.W.4, P.W.8, P.W.13, P.W.2 and P.W.7. Learned Senior advocate has placed the evidence of cross-examination after recall in respect of P.W.8, P.W.12 and P.W.7. The report of the police authorities reflect that three witnesses have already been examined. The prosecution intends to examine 58 witnesses in whole out of which 27 witnesses have already been examined. 2 The petitioner is in custody for one year two months. Other 11 accused are on bail. The records reflect that the petitioner initially absconded for a considerable period of time. Having regard to the fact that the cross-examination and the evidence of 27 witnesses are over and 28 witnesses are to be examined, I am of the view that further custodial detention of the present petitioner is unwarranted. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, Rabiul Haque Mondal shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned ACJM, Lalbagh, Murshidabad. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the district of Murshidabad without prior permission of the learned trial court. Additionally, the petitioner shall once in a week meet with the Officer-in-charge of Raninagar Police Station for a period of six weeks from date. It would be the discretion of 3 the learned trial court whether to continue or waive the aforesaid conditions. Accordingly, CRM (M) 1521 of 2026 is allowed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record.
