Learned advocate appearing for the petitioners submits that the petitioners are the parents-in-law and the brother-in-law. Petitioners surrendered subsequent to their application for anticipatory bail being rejected by the Hon’ble Apex Court. Learned advocate further submits that the principal accused was granted statutory bail.
Mr. Mitra, learned advocate appearing for the State opposes the prayer for bail.
Having considered that the petitioners have surrendered before the jurisdictional court and the principal accused is on statutory bail, I am of the opinion that further detention of the present petitioners are not warranted. As such, the prayer for bail of
2 the petitioners is allowed.
Accordingly, the petitioners shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Additional District and Sessions Judge, 2nd Court, Special Court, Malda. If on bail, the petitioners shall be physically present on each and every date before the learned trial court and shall not leave the district of Malda without the prior permission of the learned trial court.
Thus, CRM(M)1494 of 2026 is allowed.
Memo of Evidence submitted by the State be kept with the record.
The order-sheet dated 25.02.2025 filed by the petitioners be also kept with the record.
