Mr. Rakshit Joshi, learned counsel for the revisionist. 2. Mr. Vijay Khanduri, learned Brief Holder for the State. 3. Mr. Divyaman Singh Sen, learned counsel for the complainant. 4. The instant revision has been moved by the revisionist - Rajendra Singh Mehra along with compounding application with the affidavit of revisionist and Branch Manager of Uttarakhand of Gramin Bank, the respondent no.2/complainant. 5. The revisionist was convicted by the trial court under Section 138 of Negotiable Instruments Act with the sentence of six months of simple imprisonment and fine of Rs. 5,10,000/- which was also confirmed by the Appellate Court hence this revision. Now, it is contended by learned counsel that the entire amount towards the fine has been deposited by the revisionist in the Bank of respondent no.2, and hence the compounding application may be allowed. 6. The revisionist is present in the Court and the Branch Manager Mr. Prashant Kumar joined the proceeding through V.C. Both of them are identified by their respective counsel. 7. In such view of the matter, when the revisionist deposited the entire amount towards the fine, the conviction and sentence of the revisionist the offence punishable under Section 138 of NI Act can be compounded in terms of Section 147 of NI Act. 8. Accordingly, the revision as well as the compounding application are allowed. The judgment and order passed by the trial court as well as the appellate court are also hereby set aside and the revisionist is discharged and 2026:UHC:2967 acquitted. 9. No order as to costs.
