In this Writ Petition, petitioner is assailing the notice dated 07.08.2026 in proceedings No. NCR/CR/225/2025-26, issued by respondent No.3. - 3 - HC-KAR CNR: KAHC010561512026 NC: 2026:KHC:44288 WP No. 25673 of 2026 2. Having heard the learned counsel appearing for the parties and in view of the averments made in the Writ Petition and the notice, the same is in the nature of penal action. In that view of the matter, the prayer made in this Writ Petition is required to be allowed. 3. Accordingly, I pass the following: ORDER (i) The Writ Petition is allowed. (ii) The notice dated 07.08.2026 in proceedings No. NCR/CR/225/2025-26, issued by respondent No.3 is hereby quashed. (iii) The respondent No.3 is directed to conduct spot inspection with the jurisdictional ADLR on 22.09.2026 at 11.00 a.m. in the presence of the petitioner, and thereafter take decision in the matter as to whether the petitioner has encroached upon the land belonging to the Government, in accordance with law. - 4 - HC-KAR CNR: KAHC010561512026 NC: 2026:KHC:44288 WP No. 25673 of 2026 (iv) Till conclusion of the entire proceedings by respondent No.3 in respect of the survey of the subject land, respondents are directed not to take precipitative action against the petitioner.
