Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board 25.09.2026 1) The applicant has preferred this Second Bail Application under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.02/2025, registered by Police Station Madanwada, District : Mohala-Manpur- Ambagarh Chowki (C.G.) for the offence punishable under 93 and 103 of Bhartiya Nyaya Sanhita, 2023. 2) Case of the prosecution, in brief, is that on 27.05.2025, a newborn child was delivered at the house of the applicant's neighbour Digitally signed by AJINKYA PANSARE Date: 2026.09.26 10:32:09 +0530 2 without the assistance of any medical personnel. At the time of delivery, the applicant, who resides in the same neighbourhood, was allegedly called to assist the woman during childbirth. It is alleged that after the child was born alive, the mother of the neighbor-Shivram Netam, namely Sunhara Bai, strangulated the newborn with her hands, causing its death. It is further alleged that the deceased infant was wrapped in a saree and buried near the pond with the help of other persons, including the present applicant . 3) Learned counsel for the applicant submits that earlier bail application i.e. MCRC/8575/2025 preferred by the applicant was rejected vide order dated 29.10.2025 whereas co-accused, namely, Shivram Netam has been enlarged on bail in MCRC/8622/2025. He further submits that applicant was implicated solely on the basis of memorandum statements and assumptions made by the police authorities. He also submits that applicant is in jail since 02.06.2025 and the trial is likely to take some time for its conclusion, therefore, he prays for grant of bail. 4) On the other hand, learned counsel for the State opposes the bail application. 5) I have heard learned counsel for the parties and perused the case diary. 6) It appears that co-accused, namely, Shivram Netam was enlarged 3 on bail on the ground that he did not participate in the commission of murder of new born baby whereas the first bail application of the present applicant was rejected on merits vide order dated 29.10.2025 on the ground that dead body of the new born baby was wrapped and buried by the Bisro Bai and the applicant by digging out the mud and wet soil from the pond and covering it with soil. 7) Considering the direct allegation leveled against the applicant and the fact that earlier bail application preferred by the applicant has been rejected on merits vide order dated 29.10.2025, this Court is not inclined to extend the benefit of bail to the applicant at this stage. 8) Accordingly, the bail application of applicant is rejected.
