In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Egra PS Case No. 337 of 2024 dated 29.05.2024 under Sections 448/34/395/397/412 of the Indian Penal code.
And In the matter of : Sk. Aisan Hassan @ Ayasab Hossain @ Sk. Aisan Hossain @ Rahul
……Petitioner.
Mr. Anirban Mitra
Mr. Avijit Roy
……for the Petitioner.
Mr. Ajay Roy
Mr. Soumalya Dutta
….for the State.
Learned advocate appearing for the petitioner submits that petitioner is in custody for 821 days. Although charge sheet has been submitted but there has been no progress in the case.
Learned advocate for the petitioner further emphasizes on the fact that there has been no recovery of gold ornaments from the present petitioner and the trial is progressing at a snail pace.
Learned advocate for the State opposes the prayer for bail and submits, petitioner was identified in the T.I. Parade.
2 There were other recoveries from the present petitioner and there are three other cases against the present petitioner being Egra PS Case No. 743 of 2023, Patashpur PS Case No. 127 of 2024 and Patashpur PS Case No. 893 of 2023.
Having considered the present offence and the earlier nature of the offences, I am of the view that petitioner’s antecedents do not appeal to this Court to release him on bail.
Accordingly, prayer for bail of the petitioner in CRM (M) 1698 of 2026 is dismissed.
Memo of Evidence submitted be kept with the record.
State is directed to expedite the process of trial. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
