Tulsi Ranjan Das Ms. Sagnika Banerjee …for the Petitioner In this application the petitioner has sought for a direction upon the court below for expeditious disposal of the Case being No. 45 of 2025 under section 144 of the BNSS, 2023 presently pending before learned Additional Chief Judicial Magistrate, 2nd Court, Baruipur, South 24 Parganas. Learned counsel for the petitioner submits that the application for maintenance under section 144 of the BNSS was filed in the year 2025. Despite the completion of pleadings, exchange of affidavit of assets and liabilities, the proceeding has got stalled at a preliminary stage due to continuous adjournments awaiting mediation report and has not yielded any progress. Aggrieved by the prolonged delay in the adjudication of her maintenance prayer she has sought for a necessary direction upon the court below for time bound disposal of the said M. Case No. 45 of 2025. Having heard learned counsel for the petitioner and that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice and as such, the 2 service of copy of application upon the opposite party is hereby dispensed with. Having considered the submission made on behalf of the petitioner and that the proceeding is pending for a considerable period of time, I find that the prayer made by the petitioner is justified and is required to be allowed to secure the ends of justice. In view of the above, the instant application being CRR 3593 of 2026 is hereby disposed of with a direction upon the court below or Court-in-Charge of the court below to make every endeavour for expeditious disposal of the M.Case No. 45 of 2025 presently pending before learned Additional Chief Judicial Magistrate, 2nd Court, Baruipur, South 24 Parganas, and to make its best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing.
