For the State Sarwar Jahan Mr. Anindya Ghosh Mr. Souvik Das …. For the Private Respondent Affidavit of service filed on behalf of the petitioner is taken on record. The petitioner who is one of the members of Boroi Gram Panchayat submitted a no confidence motion alongwith other members of the Panchayat for removal of the Upa Pradhan before the Prescribed Authority pursuant to which the Prescribed Authority fixed the date of meeting on 3rd September, 2026 by a notice issued on 20th August, 2026. The petitioner seeks a direction upon the police authority to render necessary assistance to the Prescribed Authority so that the meeting is held without any hindrance. Learned counsel for the private respondent/Upa Pradhan submits that all the requisitionists have not approached this Court seeking police protection. The petitioner in his personal capacity cannot seek such protection on behalf of the requisitionists. Learned counsel for the State submits that the police is prepared to deploy adequate force for smooth conduct of the meeting. 2 The no confidence motion was submitted by 14 members of the Panchayat pursuant to which the date of meeting has been fixed by the Prescribed Authority. The writ petition cannot be rendered invalid merely on the ground that only one of the members has sought police assistance for the meeting. In view of the fact that the meeting has been scheduled on 3rd September, 2026, , the Inspector in Charge, Harishchandrapur Police Station, being the 8th respondent herein, is directed to render necessary assistance to the Prescribed Authority so that the meeting scheduled on 3rd September, 2026 is held peacefully without any disturbance from any corner whatsoever. The police authority shall ensure safe passage of the members to the venue so that they are able to cast their votes safely and independently. The writ petition is accordingly disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities (Suvra Ghosh, J.)
