JUSTICE E.S.INDIRESH ORAL ORDER In this writ petition, the petitioner is assailing the order/endorsement dated 21.06.2023 (Annexure-B) passed by respondent No.2, inter-alia, sought for a direction to respondent No.2 to consider the representation dated 08.12.2022 (Annexure-A). 2. Having heard the learned counsel appearing for the parties, it is noticed that the petitioner is claiming right over the property based on the judgment and decree passed in O.S.No.1196/2019 produced at Annexure-F to the writ petition. - 3 - HC-KAR CNR: KAHC010325282024 NC: 2026:KHC:45914 WP No. 15215 of 2024 3. In that view of the matter, as the petitioner is claiming right over the property in the Final Decree Proceedings in O.S.No.1196/2019, I am of the view that it is open for the petitioner herein to survey the land through a licensed surveyor and the copy of the sketch be made available before respondent No.2 to enable them to enter the name of the petitioner in the katha. Accordingly, the writ petition stands disposed of. Respondent No.2 is directed to consider the sketch prepared through a licensed surveyor submitted by the petitioner and thereafter shall take appropriate decision in the matter, in accordance with law, within a period of two months.
