Learned senior advocate appearing for the petitioner submits that there was alleged recovery from joint possession of the petitioner. Petitioner is in custody for more than seven months and charges have been framed. It has been submitted that there is no possibility of the trial concluding in near future. As such, petitioner prays for bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. Having considered the quantum of seizure in the present case is of commercial quantity, I am of the opinion that the petitioner has failed to overcome the rigours of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioner is rejected. Petitioner will approach this Court after the evidence of relevant witnesses is over. 2 Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1832 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
