By the instant petition, the petitioner, who is a senior citizen and 67 years old praying for expeditious disposal of Civil Suit No.40 of 2024, pending in the court of learned Civil Judge (Senior Division), Ramnagar, District Nainital. 3. The petitioner is the plaintiff in Civil Suit No.40 of 2024 and the respondent herein is the defendant. The suit was filed for eviction and now the main contention in the suit is that the defendant forcibly entered in the constructed property owned by the plaintiff-petitioner. Learned counsel submits that the written statement has already been filed, but, up till now issues has not been framed by the trial court. 4. The relief, as sought, appears to be innocuous. 5. In such view of the matter, the instant writ petition is disposed of finally with the direction to the learned Civil Judge (Senior Division), Ramnagar, 2026:UHC:3075 District Nainital to expedite the Civil Suit No.40 of 2024, “Atul Kumar Agarwal vs. Smt. Asha Negi”, as expeditiously as possible, preferably within a period of four months from the date of production of certified copy of this order. 6.
