In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliachak Police Station case no. 1260 of 2025 dated 12.07.2025 under Sections 21(c)/27A/29 of the of the Narcotic Drugs and Psychotropic Substances Act, 1985. ……for the State. Learned advocate for the petitioners submits that petitioner no.1 is in custody for about four months and petitioner no.2 is in custody for about three months. Learned advocate submits that the subject matter of the case relates to recovery of 414 grams of heroin from another co-accused and the petitioners have been implicated on the basis of statement of the co-accused. Learned advocate for the State opposes the prayer for bail and submits that there are antecedents of both the accused persons in respect of similar type of offences as also offence under the BNS,
2023. State is however, unable to refute the contention of the petitioners that there has been no recovery from them so far as the present case is concerned. 2 Having taken into account the locus of the present petitioners, I am inclined to release the petitioners on bail. As such, the prayers for bail of the petitioners are allowed. Accordingly, petitioners namely, Masidur Alam @ Muskar @ Maskur and Alam Sk shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only) each, with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act, 4th Court, Malda. If on bail, the petitioners shall be physically present on each and every date before the learned trial Court in seisin of the case and shall not leave the jurisdiction of district of Malda without the prior permission of the learned Special Court. Accordingly, the prayer for bail in CRM (NDPS) 209 of 2026 is allowed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
