Petitioner seeks regular bail in FIR No.75 dated 16.06.2026 under Sections 21, 27-A, 29 of Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Mattewal, District Amritsar. This is the first petition for regular bail.

As per FIR, on 16.06.2026 at about 05:00 P.M, petitioner and co- accused, who were riding an Activa, were apprehended by the police party while patrolling near Village Chogawan, Mattewal. Petitioner was found in conscious possession of 08 grams Heroin.

Learned counsel for the petitioner submits that petitioner was in judicial custody w.e.f. 17.06.2026. He did not have any criminal antecedents. Co-accused, namely, Harjit Singh alias Gora, who was found in possession of 07 grams Heroin had already been enlarged on regular bail. The quantity of contraband allegedly recovered was marginally more than small quantity. Thus, petitioner deserved to be enlarged on regular bail.

Mr. Sukhbeer Singh, DAG Punjab accepts notice on behalf of respondent-State and files custody certificate dated 26.08.2026, which is made part of the record. He opposes the prayer for regular bail, however, concedes that petitioner was not involved in any other case. He further concedes that co-accused Harjit Singh alias Gora has been allowed regular bail.

Petitioner is in custody w.e.f. 17.06.2026. His antecedents are clean. The contraband allegedly recovered is slightly more than small quantity. Considering the period of custody undergone and all relevant facts and circumstances of the case, but without commenting on merits, the petition for regular bail is allowed. Petitioner is ordered to be released on regular bail, subject to his furnishing adequate bail and surety bonds to the satisfaction of Trial Court/Duty Magistrate.

Pending miscellaneous applications, if any, also stand disposed of.
