JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused in Crime No.150 of 2026 registered by Srirangapatna Police Station, Mandya for the offences punishable under Section 109(1) and 351(2) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.150 of 2026 registered by Srirangapatna Police Station, Mandya for the aforesaid offences against petitioner herein, based on the first information dated 20.06.2026 received from Sagar Son of Suresha, who is the injured victim in the present case. During the course of investigation, the petitioner was - 3 - HC-KAR CNR: KAHC010523362026 NC: 2026:KHC:46806 CRL.P No. 11471 of 2026 arrested on 21.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5242 of 2026 was rejected on 20.07.2026. Therefore, he is before this Court. 4. It is the case of the prosecution that on 19.06.2026 at 10.30 p.m., when the first informant and his friend Jeevan went to a nearby fast-food shop and ordered Dosa, at about 10.45 p.m the petitioner and his friend Puneet came, therein on a two wheeler. It is alleged that the petitioner asked the first informant as to why he was staring at him. Subsequently, there was quarrel between the two parties and in the incident that took place thereafter, the petitioner allegedly assaulted the first informant with a dagger, as a result, he suffered injuries and was shifted to the Government Hospital at Srirangapatna. It appears that the sister of the petitioner had committed suicide and in the said case, the first informant was arrested and remanded to judicial custody. It is in this background the incident in question took place - 4 - HC-KAR CNR: KAHC010523362026 NC: 2026:KHC:46806 CRL.P No. 11471 of 2026 on 19.06.2026. The victim has suffered 5 injuries in the incident in question, out of which, 2 injuries are stated to the grievous in nature. However, the medical records would go to show that he has been already discharged from the hospital and his condition is stable. The records would also reveal that the petitioner also has suffered multiple injuries in the incident in question and he was treated in the same hospital where the victim was treated. 5. It is not in dispute that the petitioner has no other criminal antecedents. Major portion of the investigation is completed. According, the following: O R D E R The Criminal Petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.150 of 2026 registered by Srirangapatna Police Station, Mandya for the offences punishable under Section 109(1) and 351(2) of BNS, 2023, subject to the following conditions: - 5 - HC-KAR CNR: KAHC010523362026 NC: 2026:KHC:46806 CRL.P No. 11471 of 2026 a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
