31.08.2026 Item No.24 (DL) Court No.7 AJ. IN THE HIGH COURT AT CALCUTTA CONSTITUTIONAL WRIT JURISDICTION W.P.A. 18788 of 2026 Sk. Ali Akbar -Vs- The CESC Limited & Ors. Mr. Sanjib Seth, Kumar Jashovardhan Shaw. …. for the petitioner. Ms. Sreemoyee Mitra. …..for the CESC Ltd. 1. Affidavit of service filed in Court today is taken on record. None appears for the private respondent despite service. 2. The petitioner complains of inaction on the part of the respondent CESC Authorities in effecting electricity supply at the petitioner’s residential premises. 3. Learned Advocate appearing for the respondent CESC Authorities submits that the CESC Authorities are ready and willing to effect supply in favour of the petitioner but they have been unable to do so in view of resistance being offered by the private respondent. 4. Since the respondent CESC Authorities are ready and willing to effect supply in favour of the petitioner upon being dully satisfied about the petitioner’s possession in respect of the subject property, the petitioner’s request for electricity supply should not be kept waiting. 2 5. Accordingly, the CESC Authorities would raise appropriate quotation/bill indicating the amount required to be paid by the petitioner and upon the petitioner paying the requisite charges and completing the other formalities, the CESC Authorities would effect supply in favour of the petitioner by affixing a meter in the name of the petitioner at the existing meter board within a period of two weeks from the date of payment of requisite charges and compliance with all formalities by the petitioner. 6. The CESC Authorities will be entitled to approach the respondent no.3 i.e. the Officer-in- Charge, Shibpur Police Station in case any resistance is put up by the respondent no.4. In case, the Officer-in-Charge, Shibpur Police Station is approached by the CESC Authorities, the said Officer-in-Charge shall provide adequate police assistance to the CESC Authorities to enable them to effect electricity supply in favour of the petitioner. Costs for such police assistance would be borne by the petitioner. 7. Effecting electricity supply in favour of the petitioner would not create any special equity or right in favour of the petitioner. 8. WPA 18788 of 2026 stands disposed of with the above observations. No costs. 3 9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Om Narayan Rai, J.)
