Learned counsel for the petitioner submits that the petitioner is presently posted as Assistant Teacher at Government Primary School, Pandkikala, Block Pandariya, District Kabirdham, which is categorized as an E-Cadre School. He submits that the petitioner has been transferred, on mutual request, to Government Primary School, Bandhpara, Block Mohla, District Mohla-Manpur-Ambagarh Chowki. However, respondent No. 3/District Education Officer, Kabirdham, District Kabirdham, is not relieving the petitioner to enable 3 him to join at the transferred place. 2. Learned counsel appearing for the respondent/State, on instructions, submits that the school to which the petitioner has been transferred vide order dated 25.08.2026 (Annexure P/1) is categorized as a T-Cadre School and, as per the prevailing Government policy, a teacher posted in an E-Cadre School cannot be transferred to a T-Cadre School. He submits that the petitioner can be transferred only to an E-Cadre School and that the State is in the process of modifying the transfer order dated 25.08.2026, whereby the petitioner has been transferred from Government Primary School, Pandkikala, Block Pandariya, District Kabirdham to Government Primary School, Bandhpara, Block Mohla, District Mohla-Manpur-Ambagarh Chowki.Learned counsel for the respondent/State further submits that the petitioner has already submitted a representation dated 15.09.2026 (Annexure P/2) and, if the same is still pending, the competent authority shall consider the said representation and pass an appropriate order in accordance with law and the prevailing policy. 3. In view of the submissions made by learned counsel for the 4 parties, the petition is disposed of with a direction to the respondent authorities, particularly the District Education Officer, Kabirdham and the Secretary, Department of School Education, to consider the petitioner's representation dated 15.09.2026 (Annexure P/2) afresh, in accordance with law and the policy governing the matter, and to pass a reasoned and appropriate order thereon within a period of 40 days from the date of receipt of a copy of this order. 4. It is made clear that this Court has not expressed any opinion on the merits of the petitioner's claim, and the competent authority shall consider the same independently in accordance with the applicable rules and policy. 5.
