JUSTICE ANU SIVARAMAN) Learned counsel for the petitioner has filed a memo seeking withdrawal of the writ petition stating that the Mental Health Review Board (MHRB), Bangalore Division, has conducted the statutory review and that the petitioner does not wish to prosecute the matter. The memo reads as under: “MEMO FOR WITHDRAWAL OF THE WRIT PETITION (HABEAS CORPUS) The Petitioner above-named respectfully submits as under: 1. The Petitioner had preferred the top-noted Writ Petition under Article 226 of the Constitution of India in the nature - 4 - HC-KAR CNR: KAHC010475552026 NC: 2026:KHC:44516-DB WPHC No. 71 of 2026 of Habeas Corpus, praying for the production of Dr. Ruchita Khalwadekar, under the bona fide belief that she was being subjected to unauthorized and forced medical confinement. 2. The top-noted Writ Petition was filed before this Hon'ble Court on 15/07/2026 and came to be registered and numbered as W.P.(HC).No.71/2026. 3. The Petitioner respectfully submits that subsequent to the filing of the petition, the Respondent No.7-Mental Health Review Board (MHRB), Bangalore Division- conducted a formal statutory review and inspection at Respondent No.3 facility (Cadabam's Rehabilitation Centre) through a three-member evaluation committee. 4. The official review report submitted by the three- member committee of the MHRB reveals that: • The detenu, Dr. Ruchita Khalwadekar, requires specialized psychiatric and clinical evaluation. • The detenu is currently admitted at Respondent No.3 facility voluntarily for treatment. 5. In view of the independent findings and statutory review conducted by the three-member MHRB panel, the bona fide concerns expressed by the Petitioner stand addressed. The Petitioner is satisfied with the administrative review conducted by Respondent No.7 and does not wish to prosecute the top-noted Writ Petition any further. 6. The present withdrawal request is made voluntarily, in good faith, and without any coercion or undue influence from any party to the proceedings. PRAYER WHEREFORE, the Petitioner respectfully prays that this Hon'ble Court may be pleased to: • Take this Memo for Withdrawal on record; and • Permit the Petitioner to withdraw the top-noted Writ Petition (W.P.(HC).No.71/2026) as dismissed/withdrawn, in the interest of justice and equity.” - 5 - HC-KAR CNR: KAHC010475552026 NC: 2026:KHC:44516-DB WPHC No. 71 of 2026 2.
