1 CGHC010372962026 2026:CGHC:41874 NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR MCRC No. 9084 of 2026 1 - Purvendra Puri Goswami S/o. Vijay Puri Goswami Aged About 34 Years R/o. Karan Nagar, Near Ruchi Riya Sadi Centre, Changorabhata, Dindayal Upadhyaya Nagar, Raipur, District Raipur (C.G.) ... Applicant versus 1 - State Of Chhattisgarh Through Station House Officer, Police Station - Dindayal Upadhyaya Nagar, Raipur, District Raipur (C.G.) ... Non-applicant For Applicant : Mr. Prasoon Agrawal, Advocate For Non-applicant : Ms. Ritika Verma, PL Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board 26.09.2026 1) This is the Second bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicant arrested in connection with Crime No. 497/2025 registered at Police Station-Dindayal Upadhyaya Nagar, Raipur, District Raipur, (C.G.) for the offence punishable under Sections 80 & 3(5) of Bharatiya REKHA SINGH Digitally signed by REKHA SINGH DN: cn=REKHA SINGH, ou=HIGH COURT, o=HIGH COURT OF CHHATTISGARH, st=Chhattisgarh, c=IN Date: 2026.09.26 15:14:05 +0530 2 Nyaya Sanhita, 2023. Earlier first bail application of the applicant bearing MCRC No.3870 of 2026 was rejected on merits vide order dated 29.04.2026. 2) The prosecution story, in brief, is that on 21.10.2025, the deceased, who was the wife of the present applicant, committed suicide by hanging herself in her matrimonial home. It is alleged that prior to her death, she uploaded a video on her mobile phone alleging that the applicant and other co-accused persons used to harass her in connection with a demand for dowry. The marriage between the deceased and the applicant was solemnized on 16.01.2025. Thereafter, the applicant was arrested in connection with said incident. Hence, this bail application. 3) Learned counsel for the applicant would submit that the applicant is innocent and has falsely been implicated in the present case. It is further submitted that earlier first bail application of the applicant was rejected on merits in MCRC No. 3870 of 2026 vide order dated 29.04.2026. It is argued that some of the witnesses have been examined and they have not supported the case of the prosecution. He would contend that the applicant is in jail since 24.10.2025 and the trial is likely to take some time for its conclusion, therefore, he prays for grant of bail to the present applicant. 4) On the other hand, learned State counsel opposes the bail application and submits that the charge-sheet has been filed before the competent Court. It is further submitted that the marriage between the deceased and the applicant was solemnized on 16.01.2025 and, within a short span of time, the deceased committed suicide in her matrimonial home on 21.10.2025. It is also submitted that prior to her death, the 3 deceased had recorded/uploaded a video alleging harassment by the applicant and other co-accused persons in connection with demand of dowry. She would further submit that the first bail application of the applicant was rejected on merits and there is no substantial change in circumstances warranting reconsideration of the prayer for bail. Therefore, the applicant is not entitled to be enlarged on bail. 5) I have heard learned counsel for the parties and perused the case diary. 6) It is a well-settled principle of law that, while considering a bail application, the High Court cannot conduct a mini-trial or undertake a detailed examination of the evidence. The reliability and credibility of the witnesses are matters to be assessed by the learned Trial Court during the course of trial. 7) Taking into consideration the facts and circumstances of the case, the nature of the allegations, the specific allegations made against the applicant in the video recorded by the deceased and the fact that the deceased committed suicide within a short span of marriage. Further considering the fact that the first bail application of the applicant was rejected on merits in MCRC No. 3870 of 2026 and there is no change in circumstances, I am not inclined to grant bail to the present applicant. Accordingly, the bail application is rejected. Sd/- (Rakesh Mohan Pandey) JUDGE Rekha
