This application under Article 227 of the Constitution of India is at the instance of the plaintiffs praying for a direction upon the learned Civil Judge (Senior Division) at Sealdah, to dispose of the Title Suit No. 188 of 2016, expeditiously. From the order sheets appended to this application, this Court finds that one Abhishek Dey filed an application under Order 1 Rule 10(2) of the Code of Civil Procedure and 29th September, 2026 has been fixed for hearing of such application. The order sheet appended to this application further reflects that the suit is at the stage of cross- examination of PW-1. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith. In the light of the submission made by the learned Advocate for the petitioner, this civil revisional application stands disposed of by requesting the learned Civil Judge (Senior Division) at Sealdah to take up the hearing of the application under Order 1 Rule 10(2) of the Code of Civil
2 Procedure filed by Abhishek Dey on 29th September, 2026, if the same is otherwise ready for hearing and make an endeavour to dispose of the same as expeditiously as possible by the end of the Month of November 2026. After disposal of the said application, the learned trial judge shall make an endeavour to dispose of the Title Suit No. 188 of 2016 as expeditiously as possible without granting any unnecessary adjournment to either of the parties. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisites formalities.
