Affidavit of service filed be taken on the record. 2. The revisional application has been preferred by the wife/petitioner praying for transfer of Matrimonial Suit No. 106 of 2026 under Section 22 of the Special Marriage Act, 1954, pending before the learned Additional District & Sessions Judge, Fast Track Court at Durgapur, District- Paschim Bardhaman to the Court of the learned District Judge, Purba Bardhaman at Bardhaman. 3. It is the case of the petitioner/wife that she is residing at Police Station-Bardhaman, District- Purba Bardhaman, West Bengal, PIN-713101. 4. On the other hand the husband/opposite party along with his child of 5 years, is a resident of CMERI bus stand Prabananda Road, Durgapur, P.O. Durgapur 09, P.S. Durgapur, District- Paschim Bardhaman, West Bengal, PIN-713209 and has filed the Matrimonial suit at Durgapur Court. 2 5. The petitioner/wife now prays that the suit being Matrimonial Suit No. 106 of 2026 under Section 22 of the Special Marriage Act, 1954, pending before the learned Additional District & Sessions Judge Fast Track Court at Durgapur, District – Paschim Bardhaman be transferred to the Court of learned District Judge, Purba Bardhaman at Bardhaman. 6. It appears that the child of 5 years is with the opposite party/the husband herein. The petitioner resides at Purba Bardhaman and the case is pending at Durgapur. 7. Considering the circumstances and the fact that the child is with the opposite party, no case of transfer the proceedings has made out and the civil revision stands dismissed. 8.
