1. Present Petition has been filed by the petitioner under Article 226 of the Constitution of India alleging non compliance of the
order dated 03.07.2025 and 18.03.2026 passed by the Special Judge (NDPS), Bilaspur in Special Session’s Case (NDPS) KISHORE KUMAR DESHMUKH Digitally signed by KISHORE KUMAR DESHMUKH Date: 2026.09.26 10:42:31 +0530
No. 77/2025 by the police wherein a direction for preserving the CCTV footage of 05.06.2025 (06:00 AM to 11:00 AM) was given.
2. The case of the prosecution in brief is that the FIR bearing Crime No. 632/2025 was registered against the petitioner for commission of offence under Sections 21, 22, 29 of the N.D.P.S. Act. After usual investigation, charge-sheet was submitted before the Special Judge (NDPS), Bilaspur. During the pendency of the trial, the petitioner moved an application for preserving the CCTV footage dated 05.06.2025 (06:00 AM to 11:00 AM). Considering the application, learned Special Court vide order dated 03.07.2025 directed the Police to preserve the CCTV Footage of 05.06.2025 from 06:00 AM to 11:00 AM and also directed if there is objection in issuing the footage to the petitioner, they may move an application for exemption under Section 193(7) of the B.N.S.S.

A careful perusal of the order would show that learned trial Court has directed only for preservation of the footage and has not issued any direction to the Police for producing the footage before it. Therefore, no direction can be issued by this Court at this stage. If the petitioner is not satisfied with the
order passed by the learned trial Court or alleges any non- compliance of the order passed by the learned trial Court, she may take recourse available to her under the Criminal law before the learned trial Court.
