By means of present transfer application, the applicant-wife has prayed for transfer of Original Suit No.85/2023 “Yashpal Singh vs. Deepa Devi” under Section 13(1)(i-a) of Hindu Marriage Act from the Family Court, Pauri Garhwal to the Family Court, Dehradun. 4. Although a counter affidavit has been filed by the respondent rebutting the averments made in the present petition, but the learned counsel for the respondent submits that now the respondent has no objection if the case is transferred to Family Court, Dehradun. He, however, requests the Court that the respondent be permitted to appear before the court concerned through V.C. and undertakes to appear physically in case of any urgent need. 5. Having considered the submissions of learned counsel for the parties, present transfer application is allowed. Accordingly, the Original Suit No.85/2023 “Yashpal Singh vs. Deepa Devi” under Section 13(1)(i-a) of Hindu Marriage Act, presently pending before Family Court, Pauri Garhwal is hereby transferred to the Family 2026:UHC:3113 Court, Dehradun. It is further directed that the respondent shall be permitted to appear before the Court through video conferencing, except in cases where personal appearance is required due to urgent circumstances.
