This is an application under Section 528 read with Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of PRC Case No.52/2024 arising out of Karimganj P.S. Case No.308/2023, pending in the Court of the learned Judicial Magistrate First Class, Page No.# 2/2 Sribhumi. 3. The petitioner, Bahar Uddin has been shown as an absconder in the Charge-Sheet. He now apprehends that if he appears before the Trial Court in response to the summons, he may be remanded to custody. 4. The petitioner submits that he wants to contest the case and, therefore, he should be given an adequate opportunity to that effect. 5. I have considered the submissions made by the learned counsel for both sides. 6. Since, the petitioner wants to contest the case, he should be given adequate opportunity to that effect. Therefore, the prayer of the petitioner is allowed. 7. The petitioner, Bahar Uddin is directed to appear before the Trial Court of the learned Judicial Magistrate First Class, Sribhumi in connection with PRC Case No.52/2024 within a period of 15 (fifteen) days from today and on his appearance, the petitioner shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Judicial Magistrate First Class, Sribhumi. 8.
