31.08.2026 Serial no. 3 [G.S.Das] Assistant Registrar (Court) CRM (A) 1905 of 2026 In re : An Application under Section 482 of the BNSS, 2023/under Section 438 of the Cr.P.C. in connection with Shibpur PS Case No. 64 of 2026 dated 12.02.2026 u/s 64(2)(m)/308(5)/316(2)/351(2) of the BNS, 2023 & 6 of the POCSO Act. -And- In the matter of : Prince Gupta … Petitioner(s) Mr. Sagar Saha … for the petitioner(s) Mr. Koustav Lal Mukherjee … for the State-respondent(s) Pursuant to the earlier direction, a report has been submitted by the I.O. of the case. The report reflects communication of Aashar Aalo Foundation and the statement under section 180 of the BNSS. Having considered the time period which has been referred to over there, prima facie, I am of the view that, at this stage, it is not possible for this court to go into the genuinity of the documents which have been placed by the present petitioner. 2 However, even if, the documents are taken to be correct, the time period referred to over there and the date of commission of the alleged offence, do not coincide. Considering the nature of the offence, I am of the opinion that this is not fit case for granting anticipatory bail to the present petitioner. Hence, the prayer for anticipatory bail of the petitioner is Rejected. Accordingly, CRM (A) 1905 of 2026 is dismissed. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Tirthankar Ghosh, J.)
