1. The petitioners have filed this petition with the following reliefs:-
“a. That this Hon'ble Court may kindly be pleased to call for the entire records of the case from the Respondents. b. That this Hon'ble Court may kindly be pleased to quash Paragraph 10 of the Award dated 06.02.2026 (Annexure P/1), to the extent it restricts the valuation of houses, structures and other assets to the drone survey conducted in October 2021. 6 c. That this Hon'ble Court may kindly be pleased to direct the Respondents to determine compensation by taking 28.02.2025, i.e., the date of the status quo order in respect of the 14 affected villages, as the cut-off date for valuation of all houses, structures, trees and other assets, and to pay the consequential compensation along with interest, as deemed fit by this Hon'ble Court. d. That this Hon’ble Court may kindly be pleased to direct the respondents to complete the re-determination of compensation and payment thereof within a time bound period. 10.3 Any other relief, which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case may also be granted. 2. Learned counsel for the petitioners submits that the present petition is directed against the compensation award dated 06.02.2026 passed by Respondent No. 3 in respect of Village Dolnara, to the limited extent of para 10 thereof, whereby the valuation of houses, structures and other assets standing on the acquired lands has been restricted to the assets depicted in the drone survey conducted pursuant to the order dated 21.10.2021. Consequently, compensation has been denied in respect of houses and other assets constructed between the year 2021 and 28.02.2025, i.e., the date of the order directing maintenance of status- quo with regard to construction in respect of 14 villages, including Village Dolnara, notwithstanding the fact that such
7 assets are duly recorded in the physical survey conducted by the revenue authorities themselves. 3. Learned Advocate General appearing for the State, submits that Respondent No. 5 has agreed to deposit the amount of compensation as determined with reference to 28.02.2025. It is further submitted that accordingly, the respondent-State would undertake the exercise of determining the amount of compensation payable as on 28.02.2025, strictly in accordance with the applicable rules and the provisions governing such determination.
Learned Advocate General further submits that the respondent-State has no objection to undertaking such determination and upon determination of the compensation amount in accordance with law, Respondent No. 5 shall deposit the amount of compensation so determined. 4. Considering the aforesaid aspect of the matter, learned counsel appearing for the petitioners prays that the respondent-authorities may be directed to determine the amount of compensation payable to the petitioners as on 28.02.2025, in accordance with the applicable rules and provisions of law and thereafter to disburse the amount so determined to the petitioners after affording them due and reasonable opportunity of hearing. 5. Learned Advocate General for the State shall undertake a fresh determination of the amount of compensation, taking 28.02.2025 as the relevant cut-off date and in accordance with the applicable rules and provisions of law. The State is expected to complete the
8 aforesaid exercise expeditiously and upon such determination, extend the consequential benefit of the compensation so determined to the concerned petitioners without any undue delay. 6. However, liberty is reserved in favour of the petitioners to file an appropriate petition in accordance with law, in the event they remain aggrieved by the determination of the amount of compensation. 7. With the aforesaid observations and directions, the petition stands
