SB: Hon’ble Mr. Justice Amitendra Kishore Prasad Order on Board 5 24/09/2026 1. The issues involved in these writ petitions are identical; therefore, they are being heard together and are being disposed of by this common order. 2. By way of the present petitions, the petitioners have prayed for the following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to call the records pertaining to the case of petitioner. 10.2 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ, thereby directing the respondent authorities to forthwith pay the land compensation to the petitioner towards their acquired land with interest as per provisions of Section 80 of Right to Fair Compensation and Transparency of Land Acquisition, Rehabilitation and Resettlement Act, 2013 towards delay in payment of compensation amount from the date of taking possession to the date of actual payment of compensation. 10.3 Any other relief, which this Hon'ble Court may deem fit in favour of petitioner, may also be granted.” 2. Learned counsel for the petitioners submits that the land belonging to the petitioners has been taken over for construction of a road; however, no compensation has been awarded to them. Hence, the present petitions have been filed seeking payment of compensation in accordance with the provisions of the Act of 2013. 3. Learned State counsel submits that the respondents have initiated proceedings for acquisition of the land and determination of compensation. He further submits that the respondents shall initiate fresh acquisition proceedings within a period of 15 days and conclude 6 the same within a period of six months. Thereafter, upon determination of the compensation payable, the same shall be paid to the petitioners in accordance with law, after affording them due opportunity of hearing. 4. Heard learned counsel for the parties and perused the material available on record. 5. Considering the aforesaid submissions and the stand taken by the learned State counsel, nothing further remains to be adjudicated in the present petitions. Accordingly, the present petitions are disposed of with a direction to the respondents/competent authority to initiate the acquisition proceedings within a period of 15 days and conclude the same, in accordance with law, within a period of 90 days. Upon determination of the compensation, the same shall be paid to the petitioners in accordance with law in respect of the land taken over by the State Government for construction of the road, after affording due opportunity of hearing to the petitioners. 6. It is made clear that in case the aforesaid exercise is not completed and the compensation is not paid within the stipulated period of six months, the petitioners shall be at liberty to approach this Court by filing an appropriate petition for appropriate relief. 7.
