Gaunjhu, A.P.P For the Informant : Mr. Bajrang Kumar, Advocate 04/ 09.02.2026: Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the Informant. 2. The petitioners are apprehending their arrest in connection with Sariya P.S. Case No. 30 of 2025 registered under sections 103(1)/3(5) of BNS, pending in the Court of learned Judicial Magistrate, Ist Class, Giridih. 3. Learned counsel for the petitioners submits that petitioner no.1 is father-in-law, petitioner no. 2 is mother-in-law, petitioner no.3 is brother-in-law and petitioner no.4 is wife of the deceased. He further submits that deceased committed suicide and his head was found cut near Railway track. He next submits that even no injury has been found on the body of the deceased. He also submits that railway employee has stated that deceased has committed suicide which has come in the case diary. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail. 4. Learned counsels for the State and informant oppose the prayer and submit that all the accused persons have committed murder of the deceased and thereafter they threw the dead body of the deceased on the ( 2026:JHHC:3330 ) Railway track. Learned counsel for the informant submits that injury was only on the neck of the deceased and if such accident was taken place there would have been other injuries on the body of the deceased. He next submits that the dead body of the informant’s son was recovered from the Railway track with separate head. 5. The allegations in the F.I.R are strange relationship between the husband and wife. In para 12 of the case diary, Railway employee has been examined and he has stated that he has visited the place of occurrence and found that dead body was there and further he has stated that the deceased has committed suicide and that fact has been further stated by another railway employee namely, Damodar Prasad Verma in para 13 of the case diary. In para 31 of the case diary independent witness-Rajo Singh has stated that deceased used to drink and create nuisance by saying that he will end his life. Further in para 32 of the case diary witness-Lilabati Devi has stated on the fateful night deceased was in drunken condition and without informing anyone he has gone to railway track and committed suicide. 6. In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Ist Class, Giridih, in connection with Sariya P.S.
