CRM-M-41121-2026 (O&M) -1- 228 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH CRM-M-41121-2026 (O&M) Date of decision: 27.08.2026 SATPAL SINGH ...PETITIONER VERSUS STATE OF PUNJAB AND ANR. ...RESPONDENTS CORAM: HON’BLE MRS. JUSTICE RAMESH KUMARI Present: Mr. Kirat Pal Dhaliwal, Advocate for the petitioner. Mr. Surinderjit S. Nahar, Asst. AG, Punjab. Victim/respondent No.2 in person along with Mr. Pradeep Sharma, Advocate **** RAMESH KUMARI , J. (ORAL) 1. The present petition has been filed under Section 483 of BNSS (erstwhile Section 439 of the Cr.P.C) by the petitioner for grant of regular bail as the petitioner has been implicated in criminal case arising out of First Information Report as detailed hereinunder:- FIR No. Dated Sections Police Station 133 01.05.2026 69, 351 and 61(2) of BNS, 2023 (corresponding Section 506 and 120-B of IPC) City Kharar, District SAS Nagar (Mohali), Punjab 2. The above-numbered FIR has been registered on the basis of the complaint of the complainant/victim. A Zero FIR was registered at Police Station Lakhewali, District Sri Muktsar Sahib. Since the alleged occurrence had taken place within the jurisdiction of Police Station City Kharar, the matter was transferred and FIR No. 133 dated 01.05.2026 was thereafter registered at Police Station City Kharar, RENU BALA District SAS Nagar (Mohali), under Sections 69, 351 and 61(2) of the BNS, 2023. 2026.08.27 19:17 I attest to the accuracy and integrity of this document CRM-M-41121-2026 (O&M) -2- The victim, in her statement, stated that the petitioner had committed rape upon her on the false pretext of marrying her and had threatened her. 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. He further submits that the petitioner and respondent No. 2 are major and were residing together in a live-in relationship. The parties have amicably resolved their disputes and have entered into a compromise dated 07.07.2026. He further submits that they have also mutually agreed to solemnize their marriage. Thus, in view of the facts and circumstances of the case, the petitioner deserves to be released on regular bail. 4. Learned State counsel submits that the investigation is going on and the challan against the petitioner has not yet been presented. 5. Learned counsel for respondent No. 2 submits that respondent No. 2 has effected a compromise with the petitioner. In the vernacular of the compromise (Annexure P-2), respondent No. 2 has admitted the execution of the compromise and has no objection if the petitioner is released on regular bail. 6. I have heard learned counsel for the parties and perused the record. 7. As the petitioner and respondent No. 2 are adults and have already agreed to solemnize their marriage after cancellation of the FIR, it is a fit case for grant of regular bail to the petitioner, particularly as the conclusion of the trial is likely to take some time. The petitioner is in custody since the date of his arrest. Therefore, no fruitful purpose would be served by detaining the petitioner in further custody. As such, sufficient mitigating circumstances are made out to extend the concession of regular bail to the petitioner. 8. Accordingly, the instant petition is allowed, and the petitioner is ordered to be released on regular bail on furnishing bail/surety bonds to the satisfaction of the learned trial Court/Duty Magistrate, subject to the following conditions:- RENU BALA 2026.08.27 19:17 I attest to the accuracy and integrity of this document CRM-M-41121-2026 (O&M) -3- (i) The petitioner shall not leave the country without prior permission of the trial Court and shall deposit the passport in the trial Court.
