31.08.2026 Court No.35. D/L.73. Rakib (Rejected) CRM (A) 2827 of 2026 In Re: An Application for Anticipatory Bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Nazat Police Station case no. 438 of 2026 dated 14.06.2026 under Sections 64(2)(c)/351(2) of the Bharatiya Nyaya Sanhita, 2023. And In the matter of : Jinna Gazi ……Petitioner. Mr. Jayanta Narayan Chatterjee, Sr. Adv, Mr. Satadru Lahiri Mr. Manoj Mondal Mr. Imtiaz Belal .....for the Petitioner. Mr. Shourjyo Mukherjee Mr. Rohan Bavishi ……for the State. Learned senior advocate appearing for the petitioner submits that petitioner has been implicated and framed in the present case pursuant to the petitioner having signing a seizure list in connection with Nazat Police Station case no. 271 of 2026. Emphasis has also been made on the delayed manner in which the FIR has been set into motion and the accusations which have been made by the present petitioner. Additionally, it has been submitted that all the incidents started happening after the change in administration in the State. State has produced the Case Diary and drawn the attention of the Court to the statement of the victim under Section 183 of the BNSS. Having considered the same, I am of the opinion that this is not fit case for granting anticipatory bail. 2 Accordingly, the prayer for anticipatory bail of the petitioner in CRM (A) 2827 of 2026 is dismissed. Memo of evidence submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
