Mr. Sengupta, learned Advocate for the petitioners submits that, owing to political rivalry and personal grudge, the petitioners have been falsely implicated in the instant case. He submits that the benefit under Section 482 of the BNSS may be extended in favour of the petitioners. 2. Mr. Ganguly, learned Advocate for the State produces the case diary and opposes the prayer for anticipatory bail. 3. Heard the learned Advocates appearing for the respective parties and perused the materials in the case diary, including the medical documents available therein and the statements of the witnesses recorded under Section 180 of the BNSS. On further consideration that the incident occurred in the presence of direct evidence, I am of the view that custodial interrogation of the petitioners is not necessary and that the privilege under Section 482 of the BNSS can be extended in favour of the petitioners. 4. Accordingly, I direct that, in the event of arrest, the petitioners, namely, 1) Lina Mabhai Roy, 2) Dibyendu Roy, 3) Anowara 2 Begum, 4) Sayed Abed Ali Sha and 5) Raja Khan @ Sattar Khan shall be released on bail upon furnishing a bond of Rs. 10,000/- each (Rupees Ten Thousand only) each, with two sureties of like amount each, to the satisfaction of the learned CJM, Purba Medinipur and also subject to the conditions as laid down under Section 482(2) of the BNSS, 2023. 5.
