ORAL ORDER
1. Learned AGA is directed to take notice for respondent Nos.1 to 7. 2. The petitioners are before this Court seeking for the following reliefs:

"Wherefore, the petitioners respectfully prays this Hon'ble Court be pleased to; a) Issue a writ of mandamus or any other appropriate writ, order or direction, commanding the respondents to consider the claim of release the compensation of Rs.5,00,000/- which was sought under representation dt07.02.2023 i.e., Annexure-A and 05.03.2024 i.e., Annexure-B which were given to 6th respondent i.e., Tahsildar, Pandavapura., and 7th respondent i.e., the Assistant Director of Agriculture, Pandavapura, and the Demand Notice dt:27.03.2026 i.e., Annexure-C; and b) Pass such other relief/s as this Hon'ble Court deem fit under the facts and circumstance of the case, in the interest of justice and equity."
3. The petitioners are the wife and children of late Devaraju, who was an agriculturalist. He having borrowed loan for agriculture activities due to loss of crop committed suicide on 01.12.2022. In that view of the matter, the petitioners had made a representation cum application on 05.03.2024 to respondent No.7 for grant of compensation as per the Government scheme for farmer suicide, accidental death or snake bite announced by the State. The said representation not having been

considered, the petitioners are before this Court seeking for the aforesaid reliefs. 4. When a scheme has been announced by the Government and an application is made in terms of the said scheme, it is but required for the said application to be considered as per the terms and conditions of the scheme and processed as expeditiously as possible. Since non-processing of the same would render the entire scheme otiose and would only amount to a window dressing. 5. In that view of the matter, the application having been filed by the petitioners on 05.03.2024 could not have been kept pending for more than 2 years as done in the present case, especially when there is a death in the family of the petitioners as regards which a scheme for compensation has been announced by the respondents. - 6 -

In that view of the matter, this Court passes the following:
ORDER i) The petition is allowed. ii) The respondents are directed to consider the application cum representation of the petitioner sdated 07.02.2023 at Annexure-A and 05.03.2024 at Annexure-B and pass necessary orders within a period of 30 days from the date of receipt of a copy of this
order. iii) Respondent No.1 is also directed to look into the matter and establish a necessary system for consideration of applications under various schemes formulated by the Government coming under his department to ensure that the applications are considered in a time- bound manner.

iv) Insofar as the present case is concerned, the first representation has been made on 07.02.2023, which has been pending for more than three and a half years respondent No.1 is also directed to take necessary action against the concerned officers who are responsible for the said delay. v) Respondent No.1 is further
directed to consider the inclusion or the implementation of various schemes under the Karnataka Sakaala Services Act, 2011 with a time bound disposal for the said applications.
