JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. Accused in SC No.241/2023 pending before the Court of II Addl. District and Sessions Judge, Mysuru, arising out of Crime No.59/2023 registered by Alanahally Police Station, Mysuru, for the offence punishable under Section 302 of IPC, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. Learned counsel for the petitioner submits that, petitioner who has no other criminal antecedents is in custody in the present case from 14.06.2023 onwards. As on this date, six charge sheet witnesses are examined as PW1 to PW6. Since material charge sheet witnesses are examined, there cannot be any apprehension of petitioner tampering with the said witnesses. Learned HCGP, who has opposed the petitioner submits that CW11, who is the minor son of the petitioner and deceased, is the eye witness to the incident in question. He is yet to be examined. In the event, petitioner is enlarged on bail, he may tamper with the material charge sheet witnesses. Accordingly, he prays to dismiss the petition. 5. At this stage, learned counsel for the petitioner submits that this petition may be dismissed as not pressed with liberty to the petitioner to renew his bail application immediately after CW11 is examined. He submits that considering the period of petitioner's incarceration, time frame may be given to prosecution to examine CW11. 6. The submission made on both sides is placed on record. Petition is dismissed as not pressed with liberty to the petitioner to file a fresh bail application before this Court after CW11 is examined before the Trial Court. 7. It is made clear that CW11 shall be examined before the Trial Court within a period of three months from the date of receipt of a copy of this order and immediately, after - 4 - HC-KAR CNR: KAHC010532602026 NC: 2026:KHC:46713 CRL.P No. 11712 of 2026 examination of CW11 or after expiry of aforesaid period of three months, which ever is earlier, petitioner shall be at liberty to file a fresh bail application before this Court.
