31.08.2026 Sl. No. 16 Ct. No. 446 SG [ALLOWED] C. R. M. (A) 2261 of 2026 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with G.R. Case No. 1615/2026 arising out of Suti Police Station Case No. 450/2026 dated 03.05.2026 under Sections 329(4)/117(2)/118(2)/109/3(5) of the Bharatiya Nyaya Sanhita, 2023. And In Re: Reshmi Khatun & Anr. … … Petitioners Mr. M. Mukherjee, Mr. Anisur Rahaman. … for the petitioners Mr. Kalidas Saha, Mr. Sanjib Das … for the State 1. Mr. Mukherjee, learned Advocate appearing for the petitioners, submits that the petitioners are women and have been falsely implicated in this case out of personal grudge. He submits that the present petitioners be granted pre-arrest bail. 2. Mr. Saha, learned Advocate appearing for the State, produces the case diary and memorandum of evidence and opposes the prayer for anticipatory bail. 3. Heard the learned Advocates appearing for the respective parties and perused the case diary and other materials, including the injury report. Taking note of the nature of the injuries and considering the fact that the incident allegedly occurred in the presence of direct evidence and there is no allegation of any specific overt act against the present petitioners, I am of the view that custodial interrogation of the present petitioners is not warranted and that the benefit under Section 482 of the BNSS can be extended in favour of the petitioners. 4. In view of the above, the prayer for anticipatory bail is allowed. 2 5. Accordingly, I direct that, in the event of arrest, the petitioners, viz. (1) Reshmi Khatun and (2) Manjila Bibi be released on bail upon furnishing a bond of Rs. 10,000/- each, with two sureties of like amount each, to the satisfaction of the learned Additional Chief Judicial Magistrate, Murshidabad at Jangipur and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 6. The application for anticipatory bail is, thus, disposed of. (Partha Sarathi Chatterjee, J.)
