Learned advocate appearing for the petitioner submits that the subject-matter of the present case relates to alleged recovery of 37.120 kgs. of Ganja from two accused persons including the present petitioner and charge-sheet has already been submitted before the jurisdictional court. As such, petitioner prays for bail on any condition. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. Having considered the quantum of recovery in the present case and the same being from the petitioner, I am of the view that the petitioner has failed to overcome the rigours of Section 37 of the NDPS Act. As such, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (NDPS) 1833 of 2026, is, thus, dismissed.
