ORAL JUDGMENT
(PER: HON'BLE MR. JUSTICE T.P.VIVEKANANDA)
This Contempt Petition is filed complaining willful disobedience of the order dated 08.08.2022 passed in W.P. No.13892/2022. While disposing of the said writ petition, the learned Single Judge has permitted the petitioner to submit a representation, seeking redressal of his grievances, and if such a representation is submitted, BDA shall consider the same.

Learned counsel for the complainant submits that pursuant to the order passed in the aforesaid writ petition, the representation dated 26.08.2022 has been submitted. On the ground that no orders have been passed on the representation, the present contempt petition is filed.

Learned counsel appearing for the accused has filed an affidavit enclosing the copy of the endorsement dated 21.07.2023, whereby the complainant was called upon to produce certain documents with regard to the revenue site in
order to identify the survey number in which the revenue site was formed. When the counsel for the complainant was queried

as to whether the documents called upon in the endorsement dated 21.07.2023 are produced before the BDA, the learned counsel submits that the said documents are not yet furnished. Therefore, we are of the view that the present proceedings cannot be proceeded since there is no willful disobedience. However, we permit the complainant to produce the documents called upon in the endorsement dated 21.07.2023. If the documents called upon are produced, the respondents to consider the documents and take appropriate decision as
directed in W.P. No.13892/2022.
4. Accordingly, the contempt petition is closed. Notice issued to the accused shall stand discharged.
