Murtty, Advocate For the State :- Mr. Rakesh Kr. Sinha, Advocate ---- 06/30.01.2026 Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State. 2. The petitioner is apprehending his arrest in connection with Complaint Case No.517 of 2022 for the alleged offences registered under Section 33(1)(c) of Indian Forest Act, pending in the Court of learned Judicial Magistrate 1st Class, Giridih. 3. Learned counsel appearing for the petitioner submits that the false allegation is made against the petitioner of cleaning the forest land for constructing of house. He further submits that the petitioner was doing any activity that was in his plot and the petitioner has nothing to do with the alleged allegation. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there against the petitioner of cleaning of the forest area for constructing the house. 5. Considering that the only allegation is made of cleaning the 2026:JHHC:2458 --2-- A.B.A. No. 506 of 2026 forest land and it has been stated by learned counsel appearing for the petitioner that the petitioner was constructing the house on his own land and in that view of the matter the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
